These Terms of Service ("Terms") govern your access to and use of the JewelValue mobile software application (also branded in-app as JewelAI; the "Application") and all services available through the Application (collectively, the "Services"), operated by NextPixel Apps LLP ("we," "us," or "our").

"You" or "Your" means an adult user of the Services, or the parent or guardian of any minor whom you allow access to the Services, and for whom you will be held strictly responsible.

By downloading, registering to use, or otherwise accessing the Application on any local or remote device, you agree to be bound by these Terms and our Privacy Policy. Any information you supply will be governed by these Terms and the Privacy Policy as they may be updated from time to time. You agree to abide by the rules and policies established by us, which will be applied in a nondiscriminatory manner to all users.

If you are using the Services on behalf of your employer or another entity, you represent and warrant that you have full legal authority to bind that entity to these Terms. If you do not have such authority, you must discontinue use of the Services immediately.

1. Description of the Service

JewelValue is a jewelry identification and discovery tool that uses third-party Artificial Intelligence ("AI") services to analyze photos of jewelry, provide educational identification and valuation estimates, generate virtual try-on previews, and answer jewelry-related questions through an AI Jeweler chat feature.

The Application is intended for lawful, personal, and informational use. All appraisals, identifications, and value estimates are educational estimates only and are not a substitute for a certified professional appraisal, gemological laboratory report, or legal valuation for insurance, sale, or tax purposes.

The Application relies on third-party AI providers (including Google Gemini and OpenAI) to process photos and related content you submit. When you use AI-powered features, your submitted content is transmitted to one or more of these providers for processing via our backend (Cloudflare Workers). Please review our Privacy Policy and Section 7 below for full details on how your data is handled.

Features may include, without limitation:

• Scanning jewelry photos for AI-powered identification and educational value estimates
• Saving scan history and building a personal Jewel Box collection on your device
• Virtual try-on using your photo and jewelry reference images
• AI Jeweler chat based on scan results and your questions
• Access to curated educational content about notable jewelry

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country to consent to the processing of your personal data) to use the Application. By using the Application, you represent that you meet this requirement.

3. Subscription Policy

Some features of the Application require a paid subscription ("Premium Subscription"), managed through Apple's In-App Purchase system and RevenueCat.

Free Trial

Your subscription may start with a free trial. The free trial period lasts for the period specified at sign-up (currently a 3-day free trial for the weekly plan, where offered). Free trials are available to new and certain former users only. NextPixel Apps LLP reserves the right, at its absolute discretion, to determine your free trial eligibility.

Auto-Renewal

• Payment will be charged to your Apple ID account at the confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the rate of your selected plan.
• You can manage and cancel subscriptions by going to your Apple ID Account Settings after purchase.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.

Lifetime Purchase

Where offered, a lifetime purchase is a one-time payment that grants ongoing access to Premium features for as long as the Application remains available and your purchase remains valid. Lifetime purchases do not auto-renew but are subject to Apple's refund policy and these Terms.

Pricing Changes

We may, from time to time, modify pricing and billing procedures. Changes will be effective upon posting an update to these Terms or notifying you through the Application. If you do not accept the new pricing, you should cancel your subscription before the next renewal.

Refunds

All purchases are processed by Apple and are subject to Apple's refund policy. Refund requests should be directed to Apple via your Apple ID Account Settings.

4. Acceptable Use

You agree not to use the Application to:

• Submit photos or content that is illegal, harmful, defamatory, obscene, hateful, or that infringes the rights of others.
• Submit photos of other people without their consent, especially for virtual try-on or any feature that processes personal images.
• Submit photos containing sensitive personal information you do not wish to be processed by third-party AI services (e.g., government IDs, financial documents, or private health information).
• Rely on AI-generated estimates as official appraisals for insurance claims, legal disputes, sales, loans, or tax purposes without independent professional verification.
• Misrepresent AI-generated identifications or valuations as certified, guaranteed, or professionally appraised results.
• Attempt to reverse-engineer, decompile, or interfere with the Application or its backend infrastructure.
• Use automated tools, bots, or scripts to access the Application or circumvent rate limits or subscription requirements.
• Resell, sublicense, or redistribute the Services or AI-generated output as a commercial appraisal service without our written permission.
• Use the Application in any manner that violates applicable law or third-party rights.

We reserve the right to suspend or terminate your access to the Application if we reasonably believe you have violated these Acceptable Use rules.

5. Intellectual Property

Our IP

NextPixel Apps LLP and its licensors own the Application and the Services, including all worldwide intellectual property rights, trademarks, service marks, and logos contained therein.

Subject to your compliance with these Terms, we grant you a limited, revocable, personal, worldwide, royalty-free, non-exclusive, non-sublicensable, and non-assignable license to use the Application for your personal, non-commercial use (or, if you hold an applicable subscription, for the use permitted by that subscription).

Except as expressly permitted, you may not copy, reproduce, republish, modify, alter, download, post, broadcast, transmit, or otherwise exploit the Application or the Services.

Your Content

You retain ownership of the photos, messages, and other content you submit to the Application ("Your Input"). By submitting Your Input, you grant us a limited license to transmit, process, and store it as necessary to provide the Services, including transmitting it to third-party AI providers identified in our Privacy Policy solely for the purpose of providing the requested feature to you.

You represent that you have all rights necessary to submit Your Input and that doing so does not violate any third party's rights.

AI-Generated Output

Output produced by the Application based on Your Input ("Output") — including identifications, value estimates, try-on previews, and chat responses — is provided to you for informational use. Because Output is generated by third-party AI models, we make no representation that Output is unique, complete, accurate, or free from error. Identifications and valuations may be incorrect. You are responsible for reviewing Output before relying on it and for ensuring its use is lawful and appropriate for your purpose.

6. Disclaimer of Warranties

YOUR USE OF THE APPLICATION IS AT YOUR OWN RISK. THE APPLICATION AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

Specifically, we do not warrant that:

• Identifications, material assessments, or value estimates will be accurate, complete, or suitable for any commercial, legal, or insurance purpose.
• Virtual try-on previews will realistically or precisely depict how jewelry will appear when worn.
• Output will reflect the true market value, authenticity, rarity, or condition of any jewelry item.
• The Application or its underlying AI providers will be available without interruption, error, or downtime.

AI models can produce unexpected, inaccurate, or inappropriate output. You acknowledge this inherent limitation of AI technology and agree to seek independent professional advice before making financial or legal decisions based on Output.

7. Third-Party AI Services

The Application's core functionality depends on third-party AI services operated by Google and OpenAI. By using AI-powered features, you acknowledge and agree that:

• Your submitted photos and related content will be transmitted to one or more of these providers, with your explicit consent obtained in-app.
• Virtual try-on features may rely primarily on Google Gemini image-generation capabilities.
• Each provider operates under its own terms of service and privacy policy.
• We are not responsible for outages, errors, content moderation decisions, or changes in service by any third-party AI provider.
• We may change, add, or remove third-party AI providers at any time. We will update our Privacy Policy to reflect such changes.
• You can withdraw consent to AI processing at any time from the Application's Privacy / AI Consent settings; AI-powered features that require third-party processing will be disabled in that case.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER NEXTPIXEL APPS LLP NOR ITS AFFILIATES, OFFICERS, EMPLOYEES, OR LICENSORS WILL BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE, EXEMPLARY, SPECIAL, OR OTHER DAMAGES — WHETHER UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHER THEORY — ARISING IN CONNECTION WITH THE SERVICES, YOUR INPUT, OR ANY OUTPUT, INCLUDING BUT NOT LIMITED TO LOSSES ARISING FROM RELIANCE ON VALUE ESTIMATES, IDENTIFICATION ERRORS, PURCHASE OR SALE DECISIONS, OR INSURANCE CLAIMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In any event, our total cumulative liability to you for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) USD 50.

9. Indemnification

You agree to defend, indemnify, and hold harmless NextPixel Apps LLP and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Application, (b) Your Input or use of Output, (c) your violation of these Terms, or (d) your violation of any third party's rights.

10. Arbitration and Class-Action Waiver

You and NextPixel Apps LLP agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services ("Claim") shall be resolved by binding individual arbitration, and not in court, except that you may assert claims in small-claims court if your claims qualify.

YOU AND NEXTPIXEL APPS LLP AGREE THAT:

• (a) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED ON A CLASS-ACTION BASIS OR TO UTILIZE CLASS-ACTION PROCEDURES;
• (b) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL;
• (c) NO ARBITRATION SHALL BE CONSOLIDATED OR JOINED WITH ANY OTHER ARBITRATION.

11. Termination

We may suspend or terminate your access to the Application at any time, with or without cause and with or without notice. You may stop using the Application at any time. Upon termination, the licenses granted to you under these Terms will immediately cease, but Sections 5, 6, 8, 9, 10, and 12 will survive.

12. Governing Law

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Subject to Section 10, the courts located in Ahmedabad, Gujarat, India shall have exclusive jurisdiction over any dispute not subject to arbitration.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to you through the Application or by posting an updated version. Your continued use of the Application after such changes constitutes acceptance of the revised Terms.
